Hi i am working in an IT company wherein Bond was signed by a few employees travelling abroad for a period of two years. One of such employee has resigned now
The facts are as follows
The Employee signed the Agreement which was on the letter head of the company
The Agreement did not mention the Bond Amount. It only mentioned the period of two years.
Can our company invoke the Bond and deny the employee of the Experience Certificate and Relieving letter
Also in case the employee leaves without paying the bond amount how do we recover the amount of bond and whether such agreement is legal and can be enforced through the court of law
Please guide me,

Hi,
I am not sure if by just signing the 2 year agreement on a letter head would have any legal impact. Therefore, it will stand more valid if it is agreed upon on a stamp paper which is authenticated by the sub-registrar.
It would be wrong if you invoke the bond amount, for you have not mentioned that in the agreement of two years signed b/w the company and the employee.

Hi Ranji,
You mentioined that the bond does not carry any amount details and you are asking how recover the amount. Please check this one.
Next thing is, actually you cannot deny experience certificate, but you can hold the relieving letter.
If possible, you can send a lawyer notice, according the bond, a registered post and consult the lawyer for his suggestions for further actions.
If you know his present employer, you can communicate with them saying that the specific employ is under some agreement with you and left the organisation improperly, it is better to send him back, if not you may approach according to the law against the employee and present employer.
For any leagal acations, please approach a lawyer, it is the best way.
