This is a very old practice being followed nin some companies
Legal validity is doubtful. In any case it is unjustified to ask both employees to go I know Companies used to advise one employees to resign but not both
It will definitely demotivate existing employees as there are chances of a few more marriages inside
It is desirable to have husband and wife working in the same company in todays context
You should in fact motivate!!!(On the lighter side)

yes in my last company had faced same problem. that i had transferd one employees to another deptt. both are working in same group but not company or department. she is working as Receptionist.

Hi Ravi,

I have gone through the question put in by you. Well as far as my view and experience is concerned i think a married couple should not work in a same office or same department reason being that there are so many issues that comes in front of you once both are working in same office or department. One of such important issues is....

1. Working for late hours is not possible for both, if one wants to leave then the other have to.

2. Productivity also gets affected like if husband falls ill wife stays to take care of her.

And besides these many other issues are there. Though there is no such legal rule that both cannot work, but generally companies donot favor husband and wife working together in same office or same department.

Well i also think that as far as decision regarding whom to say to leave, it solely depends upon the company either u can say both of them to leave or can change their departments if possible with different shifts incase its applicable to your department.

We faced the same issue but we let it be. we did not remove either of the tw o as we believed that :
1) it would be demotivating to the employess
2) Amoral
3) setting a poor example: as we as organizations repeatedly emphasize that personal life is different from the professional life .
4) Illegal - Dismissal of employees for marriage has no legal validity in India. They can drag you to court for it.
reiterate to them that productivity cannot fall and that professional life is different from personal life.
Usually they listen and behave accordingly as they have a new relationship and would feel responsible for it.
finally
support them for the decision as it is quite a big one and wish them the best.
Remember : - Marriage has legal and social protection and by today's standards not uncommon in the workplace.
no organization has the right to intervene until you have a genius lawyer who inserted a conditional clause during the time of their joining

Hi,
Its not mandatory to remove both the employees.
It depends on the company policies. Some company has the policy that, Husband & Wife should not work in the same organisation.
In such case either of the person has to resign.

Dear Ravi,
I don't understand why should the management ask even any one of them to resign. I have seen in several organizations where both husband and wife work. And in all the cases they married only after joining the organization and after the marriage also they continued with the organization for several years. All the above organizations ensured that both of them don't work in one department or report to each other.
This should not be an issue but after it all depends on the policy of the organization.
My view is they should continue to be there in the organization as they were before marriage. If they are in the same department then wither of them can be shifted to another department.

I faced te Same Problem In My Office. It was a receptionist and a electrical guy but as they already were in the diffrent departments we didnot faced there meetings during working hours but no doubt it is for sure that when one gets sick or has to attend some social function at their places both the departments suffer.
But above all positive thing is both of them are still with us and they theirselves are now understanding that they have to be extra careful on above.
So it is Ok to Keep Them as far as they are ready to co-operate.

Me and my husband both work in same comapny , different verticals but in HR.
Our company has many instances where both partners are working .
we try to accomodate careers of both with in the company , so that they stay longer with organisation.
In todays scenario its difficult to get people , there cant be more flimsy reason than this one as quoted .
I would suggest
1) try to put them in different divisions.
2) let them report to different bosses.
3) any other thing but asking them to resign.
People are matured enough, if it doesnt work for them they will themself go away. There is nothing more demotivating than to ask a loyal employee leave on such grounds.

Hi Ravi,
Generally many industries are facing these types of problems, but in this case you have to handle it very carefully because removing may cause de motivation to other employees.
Your management has already decided to remove both but I think you should analyze what type of problems you are facing because of husband & wife relations. Both are your old employees, you can seat with them discuss & advice to resign one of them. It may work for you.
Removing both May injustice & De motivate to others also.
