I am currently employing more than 20 doctors and nurses in a private medical hospital located in the Nagpur sub-region. I would appreciate it if you could confirm whether I am obligated to comply with ESIC provisions and deduct these from the salaries of my employees.

As an employer in Maharashtra, if you employ more than 10 people, you are obligated to comply with the Employee State Insurance Corporation (ESIC) provisions under the ESI Act, 1948. This includes private medical institutions.

Step-by-step Guide to Comply with ESIC Provisions

1. Register your establishment with the ESIC: You can do this online via the ESIC portal. The necessary forms are available for download on the portal itself. After filling in the required details, you need to submit the form for approval.

2. Once your establishment is registered, you must register your employees: Any employee with a salary of less than Rs. 21,000 per month should be registered under the ESIC at the time of joining. You need to fill in the details of all your employees and submit the same for approval.

3. Deduct ESIC contributions from employee salaries: The contribution is 4.75% from the employer and 1.75% from the employee, which is deducted from the employee's salary.

4. Deposit the contributions: You need to deposit the contributions within 15 days of the last day of the Calendar month. The payment can be made online through the ESIC portal.

5. Maintain records: You need to maintain records such as the Register of Employees, the Inspection Book, and the Accident Book. These records are necessary for inspection by the ESIC authorities.
