In our company, one employee left his service without completing the notice period in May 2023. As per the Payment of Bonus Act, is he eligible for his bonus or not?

Certainly, yes, he is entitled to a bonus as he had worked for two months. He can only be refused a bonus if he had not worked for 30 days in the financial year. Not serving the notice period (fixed by the company) is not a disqualification to get a bonus. Not only is not serving notice a disqualification for receiving a bonus, but it is also not a disqualification for any matter. This is because under any act, mainly the matters connected with the notice pay or period mentioned in the Industrial Disputes Act, an employee is obligated to serve notice if he wants to leave the company.
