Dear Professionals,

If an employee resigns with one month's notice as per the employer's request, and the terms and conditions mentioned in his appointment letter, what are the rights of the employee regarding gratuity, especially if they have completed 4 years and 8 months of service?

Hi, Actually, 5 years of continuous service are required to be eligible for gratuity. However, as per a ruling made by the Madras High Court, individuals who have completed 240 days in their fifth year of service are eligible for gratuity.
