Respected Seniors, My management want me to change the leave policy of our company. In which they are providing 12 Cl and 12 SL for confirmed employees. Few are also benefited with EL too. Kindly let me aware what are rules and regulations as per employee act in 2023. If possible share the threads and data to get benefited.

Leaves to which the employees of an organisation are eligible to will depend upon the nature of the organisation like Factory, plantation, mine or shops and commercial establishment. Without knowing it we cannot comment on your query.

That means your establishment is a commercial establishment and the leave rules of your state's, ie, UP Shops and Commercial Establishments Act/ Uttar Pradesh Dookan aur Vanijya Adhishthan Adhiniyam, 1962 should be followed. Accordingly, an employee is entitled to 15 days EL, 12 days of sick leave and 10 days casual leave. You can change your leave policy only subject to section 10 of the said Act.

Dear Member,

Plz see that according to section 10(2) of this Act we are to grant 15 days of Sick Leaves. If you are only to grant leaves as bare minimum as prescribed in the applicable Act then there is need of framing any leave policy. Policy is required to be framed only when you are granting over & above leaves as prescribed by the applicable Act(s).
