One of employee (female) from my company resigned without serving 2 months notice period and still not submitted company laptop 5 months after resignation. We had sent mails & notice from HR Dept. & one legal notice from Legal Depart. for the same. As per our employment letter, every employee should not carry with her/his any device, equipment of company(such as laptop, etc.) after resignation. Kindly suggest legal action to recover company laptop from the employee which contain our confidential information.

Hi,

As per general employment terms all company Assests should be returned to the company once the employee is not continuing with the Company. Hope you have documentary proof towards the issue of laptop to that absconded employee. Please send a final letter to the absconded employee through RPAD stating that Company will lodge a Police Complaint if she fails to submit back the Laptop to the company on or before ___

As you have Legal Department they will be knowing better how to mover further on this case. Please discuss with them.
