Hi, I NEED YOUR ADVICE: My construction company is under register shop & est act Gujarat state
We have to implement a leave policy in our company. Right now company give only Sunday week off means 52 week off in a year + festival leave 13 days in a year
company is not willing to give any PL or CL.

my question is
1) is there any rule for company has to give any leave to employees
2) on my site location company give an additional 2 leave to engineers which is carry forward but the company makes a rule for the employee that if any employee completes 3 yrs then he is eligible for leave encashment at the time of resignation is it legal or not?

the Gujarat Shops and Commercial Establishments (Regulation of Employment and Conditions of Service) Act 2019, provides for 7 days CL, 7 days Sick leave for every employee for each year. In addition to these CL and SL, every employee who has worked for 240 days in the preceding year shall be given earned leave at the rate of one day for every 20 days worked in the preceding year. These are leaves in addition to the weekly holidays and national and festival holidays to be given. The number of such holidays is 3 national holidays (Jan 26th, Aug 15th and Oct 2nd) and five festival holidays as decided.
