The Workmen's Compensation Act (now called the Employee Compensation Act) will apply to everyone who is not under ESIC. So, if your employee is under ESIC, the act does not apply; otherwise, it is applicable.

But it would be helpful if you gave all relevant details instead of being cryptic.

As pointed out by Umakanthan Sir, for the applicability of Workmen's/ Employees' Compensation Act, wages are not a criterion. However, in respect of an employee covered by the ESI Act, the compensation payable as per the Employees' Compensation Act will be met by the Corporation.

Obviously, an employee of an establishment covered by the ESI Act whose salary is less than Rs. 21,000 would be under ESI. Therefore, if anything happens to him, the ESI Corporation will cover the compensation payable, and the employer need not pay it out of his working capital.
