If an employee working as a driver on a JCB with an LMV license and the loader operation closed 6 months ago without any notice to the labor union and labor department, can HR terminate the employee from the job?

Termination of JCB Driver After Closure of Loading Operation
Am I right in presuming that the loading operation was closed 6 months ago and the JCB driver was terminated? Please indicate the length of service of the JCB driver. Notice of the termination order does not have to be given to the union or labor department unless the driver is a protected workman as per the ID Act 1947.
Role of HR in Termination Process
HR normally does not terminate the services of an employee; HR only communicates the decision taken by the relevant authority. If the employee is working in the HR Department, then an HR official can decide, provided they are authorized by the rules of the establishment to appoint a person as a JCB driver.
