If an organization having 100 employees and employer conditions for PF Liabilities.
1.Employers having 90 employees out of 100 are getting more than 15000 basic salaries, employers like to take form-11, from all 90 employees is exempted from PF is it legally ok? If it's legally ok then what is social security for employee benefits, no employer wants to increase liabilities.

The EPFO has to be satisfied that 90 employees out of 100 are out of the PF coverage, submission of Form 11 alone is not sufficient. They can easily verify previous membership of PF from the Aadhaar number details and if found to have been covered, the coverage will be with retrospective effect, plus penalty and interest with or without penal proceedings for wilful default.
