Dear Sir/Madam,
From November 2016 to September 2020 (3 years 11 months), Employer has deducted EPF employee Contribution (12%) from employee salary.
But, Employer has failed to generate ECR from November 2016 to September 2020 (3 years 11 months).
And also Employer has not remitted the PF Contribution to EPFO because employer has not generated ECR from November 2016 to September 2020 (3 years 11 months).
If employer wants to go right way, Do employer need to pay both PF Contribution (EE Share + ER Share) including PF Damages & Interest FOR LATE DEPOSIT OF CONTRIBUTION (14B and 7Q) to EPFO from November 2016 to September 2020 (3 years 11 months).
Is there any other way to skip and jump from above said issues.
Is there any some other solution for this.
What is the right way.
Please provide solution and guide us.
Employee strength is maximum 6. All employee's EPF (BASIC) wages are greater than 15,000.
Some employee wants to withdraw their PF amount.
But the truth is "employer has not generated ECR and not remitted the amount which is deducted from employee's salary".

If you are employer than you may have to pay all the dues provided he has registered his firm and his employees.EPFO will can take appropriate action.
If employer has deducted epf from employees salary and not deposited is unfair practice.
