Hi All, I need help. I have resigned from my current position, and my resignation was accepted by the company. I have a 3-month notice period and served my resignation on March 4, aiming to be relieved by June 1, 2020. However, my company now wants to relieve me on April 17, despite having given me an acceptance letter confirming that my last working day would be June 1, 2020.
Please suggest what I can do in this situation, where the new organization does not consider early joining, and the current organization is looking to release me early.

Hi Mayur,
You can insist to your company that you have been willing to serve the 3-month notice period as per the appointment letter. Therefore, if the company does not wish for you to serve the notice period for 3 months, then they are bound to compensate you with a 3-month salary payout. The action becomes one-sided if the company takes a decision on its own without consulting with you.

Legally, it is wrong, and they should pay the notice period amount. However, practically, remedies are limited in present circumstances. Try to negotiate with your company for payment. They know you will be legally correct in asking for your pay. Practically, there are no easy solutions to this breach of the notice period as stated by you.
