This query is for an Organization where I give consultancy services. Its an 6 year old Organization with approximately 200 employees and as per them, since all salaries are above INR 21000 they never registered for PF or ESIC. But with growing time employees have started asking for PF accounts. In this scenario how can they go ahead? What will happen to those employees who have been working for past 6 years? Experts kindly advise

Coverage under PF & ESIC is not only depending on the no. of permanent employees but also with the count of contractual employees engaged in that organization. Hope there are some contractual employees (may be the contractor(s) are fulfilling the PF & ESI liability ) e.g. Security, Office Boy, Sweeper etc.
Condition of coverage will be from the inception of the organization ( First Trade licence, If factory- factory licence, S & E Registration etc.) and the no. of total employees 10 in case of ESI and 20 in case of PF as the case may be. It will also be required to check the salary level of permanent employees at the time of past coverage.
Check the records in details and then advise accordingly.
