Dear Seniors, one of my friends worked at Manappuram Finance Limited a few years back, and he resigned from there. After 9 years, he received a lawyer's notice/letter from Manappuram Finance Limited. At the time of joining, an agreement was executed between him and the company, stating that he has to pay an amount of Rs 6000 with an interest rate of 24% added for the 9 years. They claimed that an employment loss had occurred, but at the time of his resignation, they did not mention anything.

What should he do? Please help him resolve this issue.

Please provide clear details so that members can respond without going back and forth. Did you resign after serving the notice or abscond? What kind of agreement did you enter with the company at the time of joining? If you have completed the handover as per the employment letter, there shouldn't be an issue.

Moreover, under the Law of Limitation, the issue is not maintainable in court as it has exceeded the allowed period.

However, if you have missed mentioning any other issues in between, please do so.

The Law of Limitation goes clearly against any such claim, provided the party has not been raising any letter or claim in the meanwhile.

Legal Advice Needed for Employment Agreement Breach

I joined the company in November 2018 and signed an undertaking for two years of service, with a notice period of three months. Due to family problems, I left the job on January 14, 2019, and sent a resignation letter without serving the notice period. I have not received the salary for January and some days of November. I only accepted the offer letter through email and did not sign the appointment letter due to some unwanted conditions.

As I left the job without serving the notice period, the company sent me a notice of loss, claiming one lakh against economic loss due to my sudden resignation. My salary, as per the offer letter, was 37,000 per month. Please guide me: is this legally okay? What should I do now? I am not working after resignation and am unemployed.

I sent an email explaining my poor family condition and the reason for my immediate resignation. My grandmother passed away, and my mother is sick. My family needs me to take care of them, so I am with my family in my hometown and not working anywhere. I am not in a position to cover their loss of one lakh.

I worked from November 28, 2018, to January 13, 2019, and only received the December 2018 salary. The company has not paid the remaining amount. According to the undertaking I signed during joining, if I leave the company, I have to serve a three-month notice period. The second condition is that I will not offer my services to any competitor for 36 months after leaving the present company. The third condition is that if I violate these conditions, the company will claim appropriate economic loss.

Kindly suggest legal advice on what I should do.
