I am Pavan from, i am in job in construction industry in oil and gas sector, I have a labor license and engaged contract laboor through sub contractor those registered under pf and esi. Kindly advise, can we make the wages payment through our sub contractor using wages format in the name of Technip India Ltd and sub contractor will deposit pf and esi as per wages sheet in line with CLRA, PF & ESI act and submit a copy as a proof to us.

Pl clarify whether PF & ESI are deposited by the sub-contractor in its name or your name, has the sub-contractor too valid labour license and PF & ESI registration. Assuming that the sub-contractor is an odd entity without these registration, it is perfectly legal that the sub-contractor pays wages, deposits PF & ESI dues in your name. But it will result in a situation where the labourers could make claims against you on the basis of being your employees and these will be solid evidence against you.

Dear Sir,
Sub contractor registered under PF & ESI but not obtained labour license. Labour license in our name. Wages are prepared in our name (principal contractor) and mentioned sub contractor name also and wages paid by sub contractor through bank and PF/ESI are also deposited in sub contractor's registration and submitted to us against bill. It is legal as per act please clarify.
