I am abi i am working in a plastic moulding company last year may 5th i was joined in the company as a junior HR Executive from the month it self PF,ESI deducted from my salary but they said that your not eligible for SL,CL,EL for up to 1 year. But now i am 2 month 15 days pregnant due to my health condition i am going for 3 month leave for this leave i am eligible for salary? If suppose i am eligible but company is not given means what action i should take ?

Dear Ms.Abi,
Where you are working is a factory I think. If so, you are entitled to annual leave with wages during the second and subsequent years of service only based on your attendance in the very first year of service only. However, you are entitled to maternity leave of 26 weeks in total had you completed 80 days of service during the preceding 12 months period, if the establishment is a factory irrespective of the no of people employed or if it is a shop or other establishment, with 10 and more no of employees. Therefore, first inform your management formally with a medical certificate about the fact of your pregnancy. Out of the 26 weeks, you can avail of 8 weeks leave before the expected date of delivery and the balance afterwards. The employer can not dismiss or dispense with the services of a pregnant woman at any stage of her pregnancy for any reason. If the management refuses to grant you leave, make a complaint to the Inspector under the Maternity Benefit Act,1961 for the area where your establishment is situated.
