Consultant-labour Laws

An employee in my firm passed away recently. He had been in service with us for ten years. I want to calculate gratuity - his age was 58 years and years of service were 10.
Please help.

If you have taken a gratuity cover from LIC then the LIC will calculate it up to the age of 58, referring to section 4-A of the gratuity act. But if your company have not covered under the insurance of gratuity with LIC then you liability would stand up to the last day of the service when the employee got expired.
