Good day to all. I have established a partnership company "SriKrishna Engineers" in Udupi, Karnataka. Our core job is to download a section of the ship's monthly maintenance logs submitted for technical review to our principal in the USA from the mail server or the server of the US-based company through the internet. We then create a technical report and post it back in the folder on the server or send it via email to the appropriate ship for necessary technical action. We have 14 employees working on this task. I oversee and handle the same task, answering various technical queries related to this subject through emails. Additionally, we have one dedicated service engineer (out of the 14) who goes on board for service consultation as directed by the USA company when the vessel is on the Indian coast/harbors. Our work area is the office and the system, and all tasks are done through the internet except for the 10-12 visits by the dedicated service engineer. The service engineer is at a 30K per month salary. All the other 13 employees are paid between 10K to 50K per month. Our office is located on the Manipal highway and not in the industrial area. We have taken health insurance (cashless scheme) for all the employees, covering their parents as well.
Do we need to take ESI and PF? Please advise.

Irrespective of the nature of the job and other criteria, both schemes are related to labor welfare and are applicable when the specified level of employment is reached. This includes exempted employees for the headcount (employment strength).
ESIC coverage is mandatory when the employment strength reaches 10.
EPF coverage is mandatory when the employment strength reaches 20.

Further, you have to register "Sri Krishna Engineers" under The Karnataka Shops & Commercial Establishments Act, 1961, The Karnataka Professions Tax, and The Employees State Insurance Act, 1948 with immediate effect.
Additionally, the maximum salary is 50K. Consequently, you have to obtain a TAN for the remittance of TDS for employees.
