Hello all,

My company is a private company engaged in manufacturing activities. We are registered under the Shop and Establishment Act; however, we have not obtained a license under the Factories Act, 1948. I would like to understand the implications of not registering under the Factories Act. Can we still apply for the license at this stage?

Dear sir,

If you have engaged 10 or more persons and manufacture products with the aid of power or 20 persons working without the aid of power, then a license under the Factories Act is a must-have, and the same needs renewal promptly upon its expiry. Not having a valid license is punishable for carrying out illegal activities. Registration under the Shops and Establishment Act is not compliant. Non-registration in the Factories Act will lead to multifaceted fines and penalties. The penalties in the Act are divided into sections ranging from general offenses up to contravention of individual offenses.
