He is around 65 years old, retired from the Tamil Nadu Government. Recently, he got married for the second time. His first wife is also alive. Can the second wife receive a family pension after his passing? If not, who will receive his pension? I need clarification on this matter.

In that case, when more than one widow surviving the Pensioner, the family pension would be paid in equal parts to them. In case of their death, minor children would get till they become major.

1. Sir, in my opinion, the main issue will be what Pension Rules are applicable in respect of employees of the Tamil Nadu Government, and what are the provisions relating to the revision of pensions for its retired employees.

2. It will also be important to determine whether there are any restrictions on Tamil Nadu employees regarding contracting a second marriage even when the first spouse is still present.

Mr. Harshkumar,

I think that the poster knows that her query comes under the Tamil Nadu Pension Rules, 1978. Rule 49 deals with family pension. The second wife is eligible to claim an equal part of the family pension of the retiree after his death along with the first wife if their marriage is permissible under the personal law of the government servant.

The second query makes the things complex. It appears that you are reluctant to post all the relevant facts.
