when you employ more than 10 women employees, you are covered under the said act. there is no question of married or unmarried.

if married or unmarried female employee is not matter... in maternity benefit act. in which case the unnarried female employee shall be entitled to avail the maternity benefit can you please provide the some example......
Preamble of Maternity Benefits Act reads as follows:
An Act to regulate the employment of women in certain establishment for certain
period before and after child-birth and to provide for maternity benefit and certain other benefits.
It say women-Not married women.
No moral values are put n by saying married or unmarried woman.
As long as she meets the conditions -80 days work in last 12 months,is pregnant,her marital status is irrelevant.
The marital status of the woman employee does matter in relation to the application of Maternity Benefit Act.
Riteshmaity, Could you please clarify regarding marital status and maternity benefit. Is an unmarried employee entitled for maternity benefit in case employee becomes pregnant?

THE MATERNITY BENEFIT ACT, 1961
INTRODUCTION
The object of maternity leave and benefit is to protect the dignity of motherhood
by providing for the full and healthy maintenance of women and her child when
she is not working.
An Act to regulate the employment of women in certain establishments for
certain period before and after child-birth and to provide for maternity benefit and
certain other benefits.
You can see, it is not mentioned anywhere that "The women should be married". Hence the Act applies of all women.
There is no concept of married or unmarried mentioned in the Act for eligibility to avail maternity benefit.it is just view of the society.
Dear all,
pls clarify in our company a female employee is working from may 2015 however in financial year 2016-17 she has not worked 80 day yet. pls tell me shall this employee be entitled to avail maternity benefit as she has given application for maternity leave for during her pregnancy,
Benefit act should be considering maternity not marital status. Unmarried female should get all benefits according to ACT.
