Overtime work is an incidence of employment arising out of exigencies. Therefore, when asked by the employer to work beyond the normal working hours, it is the duty of the employee to comply with. However, such an arrangement is restricted by the factors of time and compensation. The total no of working hours per day and per week shall not exceed the maximum no of hours of work including overtime prescribed under the applicable establishment-related Act. I think the questioner works in an IT or ITES establishment. If correct, the State's Shops and Establishments Act is applicable to his establishment. The maximum hours of work including O.T is 10 hours per day and 48 per week. Therefore, if asked daily to work 2 hours, the total no of working hours including O.T would be [ (8x6) + (2x6) ] 60 against the maximum of 54 fixed under the Act.
