Dear Seniors
I want to know about esic rules, if a company is new & have 30 - 40 employees, & also has esic but there are only 10 employees who is having esic & rest dont want to enroll in esic in that condition what should i do for the employees.
Kindly suggest me better option for the betterment of the employees'.

there is no question of employees willingness. ESIC is statutory for all employees whose salary is < 15K. there cannot be a better option than this. you need to cover all the employees under ESIC and remit contribution monthly with out fail.

1. Sir, the provisions of ESI Act, 1948 and rules/regulations framed thereunder are statutory in nature, are compulsory and there is no option.
2. As an HR or responsible officer for compliance of labour laws including above Act, one has no option and in case of default, the consequences are levy of interest, damages and even prosecution of principal employer as laid down under said Act.

Hi, ESIC is mandatory for all employees having salary below 15k/month. Importantly this remains employers responsibility to enroll all employees under this scheme. However the only alternative I know is to give people contractual joining rather than full time, where esic and PF arenot mandatory. Thanks

Sir, employees working on contract basis are also coverable under said Act and compliance in respect of said contractual employees is also required to be made.

As per act no contractual workman can be deployed for work inside the factory premises without registration under ESI. Even company need to deposit contribution of daily wager, comes as and when for construction / civil work.

Dear Sir,
In an orgnisation all the employees salary is more than 15000, Now please tell me how to submit NIL return online.
Please advice as I did not find answer of this question anywher.
