Applicability of the ESI Act, 1948
The ESI Act, 1948, is a Central Act and is equally applicable in all states under Section 1(3) on factories employing 10 or more persons, but only in those areas where the government has issued a notification under the said Act. However, under Section 1(5) of the Act, it has been extended to some other establishments, namely shops, hotels, etc., by the appropriate State Governments. For coverage of other establishments under Section 1(5), especially in Maharashtra, you may confirm the position from the appropriate Regional Office/Sub-Regional Office of ESIC.
Rates of Deductions and Benefits
The rates of deductions are mentioned in the ESI (Central) Rules, 1952. You can download the Act, rules, regulations framed thereunder, and other literature from the website of ESIC, along with details of benefits available and terms and conditions thereof.
