Hi,
Can anyone please suggest what does maternity benefit act states in the below scenario?
If an employee is due for delivery and in this situation she is still continuing her duties at work, during her working hours she had to be rushed to the hospital for delivery and had to be operated. Is the employee liable to pay for her medicals apart from her paid maternity leave or no, if yes, what compensation has to be paid?

Dear Member
There is no provision of reimbursement of any medical expenses in the scenario mentioned by you.
Also note that if the employee concern is covered under the provisions of ESI then the Employer has no liability under the provisions of Maternity Benefit Act.

As per maternity act 1961 A medical bonus of Rs.3500/ - if the employer does not provide free medical care to the woman. J L Trivedi Ahmedanad
