Dear BC Arya,

I already stated that from the above cited provision, it is learnt that those having 12 months' continous service in the same establishment will get the EDLI compensation. If the service is continous, but in different establishments, what will happen? Will the EPFO deny that member's EDLI. Whatever be the provisions in the Acts, EPFO personnel will work in comliance with the instructions they have. If it adversely affect to us we can proceed for justice. But note that if the service is below 12 months, no where it is mentioned that EDLI benefit will be denied.

In the case of Family pension, withdrawal benefit etc., we will feel deviations from the act. Regarding family pension, the Act specifically states that to get this pension, there should be a contribution of minimum one month. But if there one day attendace after EPFregistration, family pension will be allotted. Regarding withdrawal benefit, the Act is particular to pay the benefit in accordance with the last drawn salry. But EPFO pay the benefit based on the average of last twelve months.

Dear Aryaji, I have no roll on the implementation part. I just illustrate the provisions of the Act, based on the precedences and practices that I experienced, enquiring the concerned officials in EPF, the class and guidance given by both the Education Officers in the Regional Office, Workers Education Department, Kozhikode and EPFO personnel etc.

If you are still doubtful, I am helpless. Try to contact the concerned RPFO.
