Hi,
I would like to know whether Privilege Leave / Earned leave for current year ( Jan to Dec 12) can be availed in current year or they are for next calender year. Also, is this governed by by any Labour Law or varies from company to company? If any particular law is applicable. Kindly mention it also.

Hello dear,
PL can be availed in the current year on prorata basis i.e. PL accrue in ones credit can be taken in the current year. For instance, in our co. we are entitled to 21 days PL and one will accrue 1.75 days PL for preceeding one month. However, we do not allow to avail current year PL unless there is any PL balance in ones credit.
PL/EL is governed by ID Act, 1947 though no. of days varies from co. to co.

Leaves which an en establishment should give to its employees is governed by the base Act under which the establishment comes. That is, separate leave rules are prescribed for factories, mines, plantations, establishments coming under the shops and commercial establishments etc. These are minimum leaves the company should provide to its employees as part of social welfare. Any leave in addition to what is specified under the respective Act (like Factories Act, Mines Act, Plantations Labour Act, Shops and Commercial Establishments Act etc) can be given to employees without any problem.
Almost all the above said Act provides that earned leave/ privilege leave of current year shall be availed in the subsequent year. However, if the company so desires, it can permit the employees to avail EL/PL in advance.

The PL / EL is governed by the Shops & establishment Act of state concern if it is service sector , and Factories Act is governed in case manufacturing sector come under factory definition. PL / EL is to be availed in subsequent year only. If any management wants give voluntarily in same year , can be on prorata basis. PL/EL can can be also accumulated up to 60 leaves in AP S&E act concern also can en-cashed 8 days in a year. in factories leave will be calculated and credited one el/pl for 20working days , that also after completion of 240 days in a year. (ID act is not dealt with leaves)

In our organization, it is being told that PL /EL should be minimum 3 days. Is this correct as per law? What if I have zero balance of sick & casual leave and need leave for one day only?

PL/EL can be availed at a time minimum three days and three occasions in a year as per state S&E laws and Factories Act 1948.
If zero balance of SL /CL will leads to loss of pay or leave with out pay ,i.e leave application to be submitted by the employee to sanctioning officer and nil leave balance leads to loss of pay ,but not unauthorized absent.
