I have resigned and given 20 days notice to company but company wants me to continue my service till 3 months notice period as per the appointment letter and I am ready to pay rest amount of notice period due to family problem at my native place. Physically I am present on duty but my mind is at my native place.
Company is not ready to relieve me after 20 days but I am not able to discharge my duty with full efficiency. I am already inform to my president regarding my problem verbally but he say I am not relieve you.
I am ready to pay Notice pay penalty.
Please advice and let me know what all precautions i have to take immediately on

i am in a catch 22 situation as i have resigned the company on 15th March,2012 with immediate effect and asked for the acknowledgement of my resignation from my line manager , he has told me verbally that he can't give the acceptance of my resignation from his end and HR will give the acceptance and it will take 40 to 45 days, meanwhile i have got offer of employment with attractive salary package from a MNC but the new company has given the condition that my joining is subject to the submission of the acceptance of my resignation .and the existing company is not providing the acknowledgement of my resignation with immediate effect.
Therefore, i am requesting you all to help me to overcome the situation with appropriate solution. ASAP.

Dear prashant, go to your president for leave request for the same period. lets see how much he approves

Hi Prashant,
you need to talk to your HR about this & am sure that there won't be any problem at all, if you are ready to pay the penalty despite of your notice period.
but beware this could create a rift between the relationship with your president.....

If your line manager is not giving you the acknowledgement you can use follwoing ways of communication,
Registger A/D
Email
Fax
Apartfrom this you can give the explaination in writing to the new organization that you have resigned from present services and not getting acceptance from them..
Aftr all your loyality only can make this situation better for you.

Dear Vishal,
I agree with Mangesh Wakokdar. I think before that, you should speak to your HR to find some middle path to have both the parties win-win situation. Else you have only left with the options as mentioned by Mangesh Wakokdar.
This will be in the interest of both in long run.

I am already talk to President & HR person but both of them refused to relieve me and issue a letter to me and for me to sign on letter on which letter clearly mention that from your resignation date you have serve 3 month notice from 12th march 2012 i.e he relieve me on 11th june 2012.

please advice me if I am not going to my office from 1st april 2012 then what Action taken by company against me. What is legal term I can take if they(company) issued legal notice to me.

Please advice and let me know what all precautions i have to take immediately on
