Dear All,
Good morning to all of u.......
I have a query regarding PF.
An organization is covered under PF & so its employees. Some of the employees are getting more than 6500/- as basic. (Suppose 10,000/-)
Now the question is whether the organization is bound to give its contribution on 10,000/- or they can give the contribution on 6,500/- only"
If they deny to give contribution on 10,000/- & give it only on 6,500/- then is it legal?
All are requested to be specific while answering.
Waiting 4 ur responses.........

The EPF statute stipulates that the organization must pay 12% of the basic salary +DA, upto a maximum of Rs 6500pm.i.e. if an employee has a basic of Rs 10,000, according to the law, he is not covered under the EPF Act but the employers is free to make a deduction of Rs 750 from the employee's salary and pay an equal contribition of Rs 750.
(12% of Rs.6500). The employee & employer is free to pay much higher contributions but there is no law binding him to do so if the employee's basic salary +DA is more than Rs6,500 per month

Dear R.K.Jain,
If the employees are already enrolled to EPF, employer is bound to pay at a ceiling salary limit of Rs. 6,500 (i.e Rs. 780); even if their salary exceeded the ceiling limit. But contribution on actual salary beyond ceiling is optional (not a statutory claim).

Dear Sir,,,
If an emp getting more than 6500/- as basic,,,then u can deduct pf only 12% on 6500/-. As per rule pf ceiling limit is 750/- only (12% of 6500/-) so there is no issue.
If an emp getting 20000/- as basic but the pf limit is 750/- only.

Hello sir,
I am ABDUL MUNEER.I want to detail regarding pf check epfc site .My pf form 19&10c.HM/VASHI/118056/60129.I left my job past 10 months .But it not received
my pf amount .It reject three time ,i dont know reason.kindly help me regarding pf site.
Hi R.k., No need to be confuse, as per EPF Act 1952 if any employe is getting basic wages upto Rs.6500 wil b entitld for PF Deduction. In other case if employe is getting basic more then Rs.6500/ suppose getting Rs. 10000/ then it wil be optional and completly depend upon emplyr. If they want to deduct then they can do. In this case if emplyr deduct pf on rs. 10000/ then it wil be rs. 1200. But we cant contribut more then rs. 541 in eps. If u hav any doubt just leav me a mail on Thanks Sunil Sharma
Hi,
For people getting salary above 6500/- you have three options - legally
Option 1 - No PF
Option 2 - Pf of Rs 780/- i.e 12% of 6500
Option 3 - Pf of whatever is the basic of the person for example If Basic is Rs 20,000/- then the
PF will be 2400/-
The choice is entirely yours. In some companies the choice is even given to the employees whether they want to opt for PF or not.
Hope your query is cleared.

Dear Sir, In my opinion,Deductions upto 6500 is statutory, beyond that, consent of employee is necessary and employer will have to give undertaking to the RPFC to the effect that he will pay equal contribution or restrict his contribution beside paying the administraive charges on that amount.
In case employee who on joining ,was not a member of EPF earlier, but getting above 6500, employer is not statutorily bound to make him a member of PF unless joint consent is made by both.
