Hi,
I am working with the company since last 10 months and I am a confirmed employee. I have also got some increment in current financial year. I am pregnent lady and my delivery is expected in coming dec. Now my company forced me to resign and they are not giving me any specific reason ? They said if you will not resign then we will terminate you.
Pls. guide me what can I do in such case ? Shall I take some legal action or not ?
What should I do ? Pls guide me.....

Cannot force to resign without valid grounds. Even for termination, employer is liable to give vaild reasons. If not their action can be question in court of law.

mine is the same case , only difference is that i joined this company in the Apr2010. ,is it possible that my employer will ask me for resign,as for other lady they asked me to fill the same vecany on her place?

I am facing the same problam i joind insurance co in Sep-08 now thay forced me to resignation and this is verbal communication from my seniors otherwise thay will terminate me.

ya..Mr.Manmohan is right...they can not force u to resign without any reason..and also they can’t force u to resign according to maternity act.

From employer point of view if an employee gets pregnant at the time of employment , I will put more work pressure so that employee gets harassed and resigns herself. No employer like to give salary for some one getting pregnant and employer to take of them.
what you can do . Give the company in written that maternity benefit you do not want from the company and would like to be on leave on health background. This the employer will definitely understand and they will not ask you to resign. Remember , organizational politics is very bad and at any moment it can happen.
An employee can just talk about legal action, but cannot take any action in practical. We all know how our Indian law works :)

Hi. Nope, an employer should never force to resign nor terminate any employee without valid grounds. Don't get intimidated. Seek legal advise so would be guided properly. I wish you well and your baby.

Yes it is true that employer must present legal and valid grounds.
But practically, if we look forward, you can win on the leagal aspects, but what about the relation of employee and employer afterwards?? If a organisation demanded resignation forcefully, they may not be good employer for you in future even they didn't terminate you.
So better to negotiate for the time untill you get another good job.

Employer has no moral right to terminate any employee without any valid reason.
If there is a reason, it is a long process to terminate the employee i.e issue of show-cause-notice,
instituting for Domestic Enquiry, if the explanation is not satisfactory, appointment of Enquiry Officer, Enquiry Report etc. Based on the enquiry report, the employer is having a right to terminate the delinquent employee / or to ignore the enquiry report
