I was asked to leave my job as part of the retrenchment process in our company. My last day of working was 17 Feb. I have not yet received my full and final settlement. Whenever I call, they tell me it will be done by the weekend, but that does not happen, sometimes my calls are avoided.
My question is, by when should I receive my full and final settlement according to the Maharashtra Labour Law, and what can I do about the delay?

Hi,
Irrespective of the labor law applicable in Maharashtra, you are entitled to your Full and Final settlement (F&F), and the date indicated by you qualifies you to make the claim immediately. You may issue a notice to your employer to settle the dues in writing, failing which you can pursue the matter legally.

You are advised to contact the Labour Officer/Commissioner of your area (where your company is situated). The concerned Government authority will take care of this matter, and the company will respond to your problem immediately.

I would suggest you to meet your ex-boss and say politely, "I need my full and final settlement draft copy, since my new organization is asking for it." You are the right person and have the responsibility to ask for it. I hope this will work out for you.

It's been 4 months since I left my old company based in Noida. To this date, they have only paid me 50% of the full and final amount. It was promised two weeks before that it would be taken care of by last March 2013. However, my boss is now speaking in a rough manner, asking me to have patience. I have already been patient for 3 months, and now they are saying it may take more time. As an HR person, I am well aware that they haven't fully paid any full and final settlements in the last year, but the former employees are not pressuring them.
Since the amount is not substantial, how can I settle my full and final amount in a reasonable way?

Ansari filed an application before the officers of the Labour Department for full and final settlement.
If the establishment has less than 25 employees, then go to the Labour Inspector/Senior Labour Inspector. If there are 100 employees, visit the Labour Officer. If there are more than 100 employees, go to the Assistant Labour Commissioner of the concerned area of the Labour Department of the State.
