Hello Friends,
I am in a big dilemma. I am the HR of a private firm. One of our employees was appointed in the company due to personal relations between an employee's father and our employer. Now, the problem we are facing is that we are having a lot of issues with the employee concerning work. Our employer has decided to send the respective employee on a long vacation for 6 months. In short, he wants to terminate the employee, but our employer does not want to use the words "suspension" or "termination." He also wants to ensure that the personal relationship is not harmed. He has requested me to draft a letter regarding this case very sensitively.
My question is, what are the liabilities if an employee is sent on a long vacation, and what are the liabilities if an employee is suspended for 6 months (with or without pay)?
Kindly help me with the same.
Thank you.

Dear,
You cannot suspend someone for 6 months without any reason. If you will suspend someone, you have to issue him a charge sheet for the misconducts he has done. In your case, there are two solutions:
1. You call that person and tell him that management is not interested in you, so it's better you resign.
2. You call that person and tell him that due to recession or any other reason, we request you to be on leave without pay for 6 months. He will understand himself that the company does not want him.

Hello Dear, After 6 months if he comes back and with the same way of working attitude what will be your action. Please find the permanent solution. This is my opinion. Thanks Thiru
