As for revised Minimum wages notification regarding Shop and Establishments in Kerala, I currently have the hard copy of Labour Gazette received at my office. Incidentally I don't have any scanner with me for scan it for posting. Will try to put a scan copy by next week.
For persons interested in Labour welfare information in Kerala, the Labour Department publish a monthly magazine in Malayalam called "Thozhil Kshemarangam" with information on minimum wages notification, variable DA point etc. One year subscription costs Rs.100 only and it could be obtained by sending M.O to: The Editor, Thozhil Kshemarangam, Labour Commissioner Office, Housing Board Bldgs, Thiruvananthapuram-695001.

Mr Rajeesh Is the basic inclusive of any special allowance the company provides?what % of the gross is Basic? Smitha
16th November 2009 From India, Thiruvananthapuram
Basic Wages is the most relevant portion of Minimum Wages. It does not include any other allowances or benefits. Purely it is the base or the relevant portion of wages fixed by the Minimum wages committee appointed through notification by the government. Every other allowances are paid to employee in addition to the Basic wages. Basic wages is 100% Basic wages only.
Variouble Dearness Allowance based on Consumer Price Index and Municipal Allowance etc are paid in addition to the Basic wages.
As per Supremecourt judgement Minimum wages contain only two portion-Basic wages and DA for calculating the Gross Minimum Wages.

The (Dearness Allowance) D.A point is based on the Consumer Price Index. With the increase of inflation or fluctuation in market price the D.A point may vary. The D.A is fixed on certain years. The current D.A is based on 1998-99 index. You can get the latest minimum wages scales from nearest Labour offices. I will give you the exact information of nearest Labour office if you tell your location.

The main category of Hotels as per the revised salary is as follows.

Dear Sir
We are a Electrical Contract Company having offices at Kozhikode & Kottayam doing various electrical installations and having a industry for fabrication of electrical panels and having a category of employees
Office Manager, Accountant, Draftsman, Steel Fabricator, Electrician, Helper, Painter, Driver (LMV), etc
What is the minimum wages applicable for us? and any websites can i download the said GO?
Thanks
26th January 2010 From India, Bangalore
Dear Sudhanandan,

I beleive your est/company comes under Kerala Shops and Estt Act and not a Factory( unless it involves in a manufacturing process) then these scales applicable for you.

Category Basic - DA(nov-Thrissur) - Municipal Allowance

Office Manager 4204 + 797 + 100

Accountant 3954 + 797 + 100

Electrician 4104 + 797 + 100

Helper 3877 + 797 + 100

Driver(LMV) 3954 + 797 + 100

Incidentally I could not find any specific scales for Draughtsman, Steel fabricator and painter. But Similar Scales of Steel Fabricator is Fitter/Mechanic/Technician is Basic-3954 and for PAINTER it may considered as 3954(Polisher similar category). Draftsman may be technical staff hisbasic may be equalled to that of an accountant, i.e 3954.

Latest D.A point at Kozhikode and Kottayam is available from Labour offices or website of economics and statistics dept.Dearness Allowance at the rate of Rs.24.90 for every point over 130 points should be calculated. At Thrissur DA point of nov is 162. so 162-130=32x24.90=797

Service Weightage-All the employees having service from 5-10 years should pay 5% of the Basic, 10-15 years should get 10% of the Basic and 15 years or more should give 15% increase in the Basic pay.

Write back for more details

3rd February 2010 From India, Calicut
Dear Chikku Babu,
I was out of station for past few days. So couldn't reply in time. As for my opinion I think your establishment belongs to a factory, where a manufacturing process (of transformer equipment)is going on. So the Gazette notification for shops and Establishments - G.O(MS) 100/2009/LBR dated 23.7.2009, w.e.f 1.4.2009 may not applicable for your establishment.
In my opinion the process(from your words) going on your establishment may be related to minor engineering, where the revised minimum wages rates are yet to be notified. So the old rates still apply.
You may contact me for latest M.W rates via my mobile on office days, please contact Mr.Muhammed Ziyad or Smt. Sarala Asst Labour Officers of Ernakulam. Their offices are in Civil station Kakkanad.

Does DA have to be caluculated sepeartely...can it be a part of the salary.
could you let know of the slabs that prevail in a trading/retail unit.for sales personnels.
what if the remaining portion of the salary other than Basic and DA is also fixed and not based on reimburables?
Who include in grade C and D ?
smitha
22nd February 2010 From India, Thiruvananthapuram
Yes, DA must be calculated seperately as it changes upon the change in Consumer Price Index(D.A point). Wages consists of two portions-Basic Wages(constant until next revision) and fluctuating D.A.
Salesman/Saleswomen-Rs.3954 Basic+Rs.797(DA in Thrissur)
Group C include Packer, Cleaner, Washerman-Rs.3877 + Rs.797(D.A)
Group D included Peon, Watchman, Attender-Rs.3800+Rs.797(D.A)
The only condition is that the total minimum wages(basic+da) must be paid to employees. Any addition exceeding Minimum Wages is not a concerned matter and employer is free to give anything in addition to MW.

Hello i am writing this to you all to suggest me what to do in this situation. I am working as a Hr executive in a printing company and and want to share the embezzling done by my manager. when we distribute salary among workers and manager used to take the salary of workers who had left the job by signing on the salary sheets of the left workers .i want you to suggest me what can i do in this situation even my manager is not behaving well with me these days .i am very much harrased by him .
9th January 2013 From India, Chandigarh
Hi rahul,
What you can do is that you have to report the above facts to your employer. What your manager is doing is a wrong thing. No manager has a right to take the salary of the workers. What they are doing is a criminal offence. They are liable for forgery. If any one of the said workers gives a compliant then you will also liable as an HR executive. Even your employer will also be liable for the same. The best thing you can do is that you have to inform the same to your employer.

Dear Sir
Our establishment is in Kozhikode. As per Kerala Minimum Wages Act - please confirm the following is correct.
Example Calculation:
Basic : 5655
Variable DA : 4115 ( CPI - 323, above 130 @ 21.32 per point -- 323-130=193*21.32 = 4114.76 --> 4115)
Service Weightage : 735 (5655 * .13 = 735 --> 13 years of service - 1% per year)
Corporation allowance : 200
Total : 10705.00
Less: ESI Employee contribution @ 1.75% of 10705.00 = 187.00
Net Payable : 10518.00
(Note: Since the employee strength is less than 20 No PF to our firm)
a. What is the yearly increment to be given for next year? Is there any minimum amount or percentage for yearly increment?
b. Is it compulsory to merge the DA with Basic after 1 year or so..
c. Is there any more deductions or additions on the above workings.
d. Bonus : If the full attendance : 10705 per annum - full 1 month salary or 9770 (only Basic + DA) - which is applicable?
e. Professional Tax as per Corporation Norms - we will deduct & remit half yearly basis
Please confirm
