I have formed a new PVT LTD company -started operation since Apr-1,09. Total staff strength is 20, Myself and my wife are Directors. We are into software Distrbution. I wish to know (1) whether PF / ESI and any other such thing are compulsory. (or we can give a flat lumpsum salary). If Yes what is the ideal Salary Structurefor employees? (2) How many CL, sick leaves medical leaves etc. are compulsory to give to staff while operating as PVT LTD company?

As per my knowledge
1 P F is compulsory for the organisation where employees salaries basic is less than 6500.00, basic above 6,500.00 (not gross) pf can be exempted.
2. 21 days leave is compulsory as per bombay shops & establishment act.
3. ESI is applicale for employees whose GROSS salary is less than 10,000.00
3. Workmen compensation policy / Mediclaim is applicable to the employees whose GROSS salary is more than 10,00.00
4. offer letter sheould be given before joining, so employees are sure of their joining
5. I cards to be given on the first of joining
6.Probation can be kept for 3 months, after 3 months employees can be given confirmation cum appointment letter.
Notes : All the benefits are applicable only after completion of probation period and also depends upon mutual understanding
