Hi Would like to check with you all that 2nd October is mandatory off for offices or it is optional. Somebody was telling that All National holidays are mandatory off Thanks Rakesh

Correct me if I'm wrong, but I think units that work round the clock, every day of the year, have special provisions for mandatory time off. You need to contact the legal authorities concerned for details of such provisions.

Dear Jeroo,

You have a very good query. News channels can't afford National Holidays. Even Doordarshan doesn't. Moreover, essential services like mess, DG, Security, etc., continue on National Holidays as well. Has anyone any explanation as to whether it is legal or not? Anyhow, we don't have any option. Is there a legal way or procedure for the same?

Hi guys,

All national holidays are compulsory offs, and hence 2nd October should be a compulsory off too. In fact, if there is a check by the authorities and the company is found to be in operation on those days, it could result in the arrest of the directors/owners, etc., and/or a fine.

In case a company has to work on these days, they have to seek permission from the concerned authorities. In my case, since the company I work for is registered under the Shops and Establishment Act, we would have to seek permission from the local office of S&A. Your labor consultant can help you with the letter format, etc.

Hi all,

Every state has an enactment called the Industrial Establishment National and Festival Holiday Act, which provides for the grant of national and festival holidays to persons employed in industrial establishments. The state specifies in the Act the number of national and festival holidays to be allowed to the employees of any industrial establishment.

Usually, 26th January, 15th August, and 2nd October are common National Holidays for all states. Some states declare a holiday on May 1st while some do not. Festival holidays are declared by the employer, and approval for the statement showing the holidays allowed in each calendar year should be obtained from the local Labor Inspector where the industrial establishment is situated.

If any factory/establishment intends to work on the holidays declared or to change the specified holiday by the state, prior approval or an exemption order with respect to the same should be obtained from the Labor Inspector by filing an application.
