This is Rahul. I am working in a pharma company where PF and ESI get deducted from our salary, but we have not yet received the ESIC cards. Kindly guide me on how long one has to work to obtain the ESIC card. Can an employee be eligible to withdraw/reimburse the ESIC claim?

You can download your TIC directly from the ESIC website as it is online now. This TIC is valid for up to 3 months. After this, you have to apply for a PIC (Permanent Identity Card). Ask your HR person to help you get your PIC through the above-mentioned procedure.

ESIC amount is deducted from employees' salary, and if the company does not have an ESIC Code for different states or ESIC authorities, what happens to the ESIC amount? How can employees claim it, or can they not? Please guide.

When ESIC is deducted from an employee's salary and the company does not have the ESIC code of the states, what happens to the ESIC amount? How can the employee claim it, or can they not? Please guide. Kindly revert.

Hi Anjali,

If any organization doesn't have registration in ESIC, but they are deducting the contribution from employees, they keep that amount in their custody. However, when they register with ESIC, they have to pay the entire amount from the first deduction to the last duration, including the employer's share, along with damage charges and interest charges for late payment. The amount of damage and interest charges depends on the number of days late.

If they are deducting ESIC, it means they know their organization comes under the ESIC Act or is applicable for the same. Therefore, they have to urgently register for it. Perhaps they are already working on it or have already applied for it.

Regarding your second doubt, you will not be eligible to receive any benefits under the same act until they have registered and paid the amount to ESIC.

Hi :-P

This is Sudheer. I am working in Pharma Co. We had paid a contribution period from Oct '06 to May '08, 6.50%, on 28-06-2008. However, on 06-Feb-2009, we received a notice from ESIC for damage charges and interest charges due to the late payment.

How to calculate damage charges and interest charges?

Dear Paresh M. Vyas,

As an ESIC employee, please submit Declaration Form 1 within 10 days of receiving your CRD and within 90 days of receiving your ESI number. While ESI reimbursements are not provided, you will receive benefits under the said act.
