Dear Sir,
I am Brinda Shah working in an engineering company, one of our site engineer left the company without prior information or formal resignation. And he also took the 70000 Rs. of the company with digital camera. So i want to write him a legal letter that if you will not submit the same in a week's time, legal action will be taken. So please help me in drafting the letter.

Dear Sir,
Firstly few questions to be ask for yourself. Did this employee is permanent employee. Have you taken anything in Writing, while giving this amount and Camera. Do you have his correct present and permanent addresses. While handing over the Camera, have issued a Gatepass.
Once above issues are done properly, you need to narrate the whole information into his warning letter with dates & timings. If you can send me more information on this, I can help you writing letter.

Mr. Madhu, its very useful information. Mr. Shravan thanks for your suggestions, yes he was temporary employee, but we have written records that we have given him the rupees as well as the camera, so i proceed in writing a warning letter to him.

Dear Ms.Brinda,

Firstly, write a formal letter addressed to both his current communication address and permanent home address as well stating that you were absent from the work without auhtorised leave/permission (as applicable).

Secondly, state that he had carried company's property (by description) and not returned as on date, which is hampering other planned requirments.

Thirdly, mention that if he does not report for duty well within stipulated date (say week's time) then the company will be contrained to proceed further as deemed fit.

Wait and watch for his response and if he does not respond to your mail, then report the incident to all concerned police authorities with facts and figures with a request to intervene and help you to recover the company's property (movables) he had carried away.

Meanwhile, you may also refer to his references, if any as given in his CV and employment application and report the incident to such references too.

Pl do let me know if you need any further details/clarification to resolve the issue.

The above irregularity seems like intentional malpractice and you are therefore advised to clarify the reasons with in 48 hours of receiving this letter failing which the company will proceed action against you.

Please do post the progress in this case. Here you have to take action for two issues. Firstly recovery of Rs 70,000 plus the Camera or its present replacement cost. Secondly, action against the employee for the act of indiscipline. i.e. not reporting for duty.

The action of abovementioned employee falls under the provisions of Indian Penal Code, by not returning the money and digital camera the employee has committed criminal breach of trust, if you have proper evidences you can file F.I.R. in the concerned Police Station and start proceedings against him, there is no legal requirement of giving any notice to him for this action.

Sub: un-authorised leave or leave without information
It has been observed from your attendance record that you are not reporting your duty from date ---- without prior leave or infomation to the management ,which is adversly affecting the smooth functionig of the company .
