Dear Yashwa,

I appreciate ur concern of statutory obligations.... I want to detail/clear all the doubts or mis interpretation among all the members about this issue:

i) Due recent planning of computerisation of all ESI Offices/ Dispensaries & Hospitals through out India with networking facilities.....for BETTER SERVICES TO INSURED PERSONS, esic has planned to provide 2 SMART CARDs to all its Insured Persons (one for the Individual and another for their Family members...there is no rule that their dependent family members should be residing along with the I.P), which u can treat or consider as a HISTORIC & REVOLUTIONARY change took place in the Service Sector, esp. Govt. Organisations;

ii) To make it success of providing the smart cards to Insured Persons, all the employees who are coverable under the ESI are supposed to enroll for the Photo Camp by submitting the revised declaration forms with latest family particulars;

iii) To make this programme as 100%, it is highly needed the cooperation from the employers and employees.... What is PITY IS THAT EMPLOYEES ARE NOT CO-OPEATING though the EMPLOYERS ARE COMING FORWARD..this is the Psychology of the employees, who oftenly do not show interest in any REVOLUTIONARY CHANGES, including POSITIVE CHANGES.... We should appreciate that SOME BETTERMENT is always good than the WORST.....being Developing Country...We all must ACCEPT THE FACT.

iv) Coming to ur question, as an employer U will not be MADE LIABLE FOR NON ENROLMENT OF ALL UR EMPLOYEES FOR PHOTO CAMP.

v) As an employer Ur responsibility is to submit their Declaration Forms to the concerned Branch Office and getting Ins. Nos. to all such employees, there after responsibility of provision of manual card/biometric Card is the responsibility of the Corpn.,

vi) What corpn., trying to make is that they want to enroll the maximum no. of eligible I.Ps through these Photo Camp.

vii) THIS IS HIGH TIME TO REALISE ALL THE COVERABLE EMPLOYEES TO ENROLL THEMSELVES VOLUNTARILY TO GET THE BENEFITS UNDER ESI SMART CARD..........

What I personally feel is that being H.R. forum people we have to know the facts and comment, in any organisation small loop holes will always be there, in the same manner the solutions for such loopholes are also very much available.....

Please stop in criticising ESI and know about the benefits FIRST..... In case of any doubts u can see my posts or u can call me on 09443434313 or mail to ...

One day or other I am having confidence that ESI SMART CARD will become the best MEDICAL CARD in the world..........

Dear members of this forum,
Is it not funny that we are forcing a "benefit" on the employees as it is a statutory requirement. Is it not time to re-visit these statutory "benefits" ?
Due to the existing laws the employers are forced to deduct contributions & make their own contributions for a "benefit" that nobody wants. This leads to employees being dis-satisfied specially in a country like India where the labour force does not understand the existing laws. Is it not the responsibility of ESIC to educate their "beneficiaries" of the provisions of law & the rights of the beneficiaries?
Should ESI system be continued when Insurance companies are coming up with innovative medical insurance policies everyday?
I am looking forward to your responses on the above issues.

In this world when you try to do some good things, hurdles come up. We have to tackle this kind of situation in a very cool way. First try to convince them regarding the benefit of ESIC. Give them the booklets which are available in ESI office. Give them the ESI internet link (ESIC - Headquarters' Office) to go through. If they do not listen to you, then create a format of Undertaking on behalf of company. In that you should mention that, if they do not comply or do not complete the formalities of ESIC, then they will be responsible for any loss occurred to them or any family members of any means. If they do not complying it, just give them a memo. Next remove them from payroll. Once you start removing people, others will fall on the track and start following your process. I think this will work.
