thank you all for your guidence
yes he is a member in ESI
n also we have submit accident report to ESI
but now he want claim for the priod he was on rest(1 month salary)
becoz of negligence he did not update his recovery period to ESI
now ESI is not ready to give such claim as he is late
:?:in such situation is there any liability on co. for such period
moreover on his request one of minister call me for his compensation.

Hi neha,
you are safe as co. Is covered under esi and accident report is submitted.
Esi cannot in any case denied him benefits! He was operated by esi and esi has to give him rest period salary just contact manger of local branch and if still not your problem solved then meet esi inspecter and if still not then file a written complaint to esi head office, and tell the minister to help yourself to get the benefits to the empoloyee thr' esi (govt. Body made for these purpose only)
