I have a small Clarification , if an employee does not want to be ESI member what is the procedure for it and want to know whether if the employee cancels ESI member ship the monthly deduced amount will be paid to the employee.

As per ESI Act every employee working in the organization is to be covered under ESI and contributions shall be paid. Only those employees whose monthly salary more than Rs.15000 are exempted from ESI Contribution. ESI will not refund the deducted amount in respect of Contribution made the employee.

ESI is not a voluntary scheme.....its mandatory if you are working in an ESI covered factory/estt. and drawing the wage ceiling below 15k..............
Its not like EPF for refunds........

You know it very well that ESI should be exempted if the salary is more than Rs.15000/-
but you are saying Rs.14550/- to be exempted from ESI. How is it possible? This is not on the basis of will & pleasure of the individual employee. You must increase the salary or otherwise your employee is liable to pay

All employees whose salary below 15000/- esi deduction is a must. It is statutory obligation on part of company. Not employee choice. Govt has framed this rules, keeping in various factors of the employees drawing that salary. In case if company can raise his salary above 15000/- then it is not required, only PF deduction to be made

its statutory Obligation and cannot be excluded if the esi wages are less than rs.15k. and it is employers responsibility to follow the norms of the ESI act.

if employer want that one more employees are getting salary 14550,they can saving esi deduction ,some amount pay and show in salary more than 15k, and extra amount deduction as a advance

The ESI is a unique, multi-dimensional and self-financing social security scheme in which every contributor is a beneficiary or benefactor.I don't understand why are you not interested for the coverage.It has host of benefits for you as well as for the Employer, who cannot have separate medical benefits and insurance coverage for his employees.You have no choice other than to be covered under the ESI scheme as you are drawing a salary of less than Rs.15000/-.There are only two exceptions on the following grounds:-
(i) Persons employed in non-implemented area by a covered establishment can be exempted on application made to the corporation.
(ii) Persons employed in a covered establishment or factory having his headquarters in an implemented area but who remains away for over seven months can be exempted on application,subject to certain prescribed conditions.

Please add Rs 692 /= towards employer's contribution of ESI in the salary of the employee with the approval of your employer so that the gross salary of the individual exceeds Rs 15000 /= and he goes out of ESI coverage.
