If any employee did not serve his notice period, what actions are taken against him?

HI,

If the employee serves proper notice period as per Appointment terms he/she can be relieved properly.

However if the employee partially serves notice at the discretion of the employer balance notice period days can be recovered from employee salary.

If the employee is not agreeing for proper notice and also not accepting to make payment in lieu of notice period then it will result in termination of employment and he/she will not be eligible for proper relieving.

Management can initiate action, based on the terms & conditions mentioned in the Appointment letter (separation clause) of the concerned employee. You can adjust the notice period salary from his F&F settlement, or, ask him to deposit the same, before issuing relieving order, and release his F&F dues.

However, depending upon candidate (his behaviour at works, punctuality and attendance, job performance, his way of interaction with his superiors, peers and subordinates, his length of service in the company, and his future career prospects, management can exercise discretionary powers.
