Hello There,
I have just completed my MBA and was recruited by a company for BDE post. In the recruiting process me along with my friends (all) were told that we will be appointed on a salary of 15k per month but for a duration of 6 months we will be trainee and will be getting 10k. we also signed a bond with the company for one year of employment and on breaching of that we have to give the company 1Lac rs which is the organisation has took from us as PDC cheque. we also deposited all our certificates with the company which is not mentioned in the agreement. now we are into a situation where the work environment is not good and even the salary we are getting is unable to survive here. we need to move out from here so need your suggestions.

However , as per your lines , this contract agreement (Particularly Your's) is a void one. Action over the Counter only will help you. Put the resignation and fight for your documents. Hopefully you will get them back. Have you joined through any agency?. Did your company spent against your recruitment or Training?

Hi Biswajit Dash,
I don't want to ask you about why you have signed the bond and given a cheque worth of 1 lakh. However want to know whether have you mentioned a date in the cheque given or is it non-dated one. I understand that you have mentioned PDC, still wanted to take a confirmation. Did you receive a receipt for the certificates submitted to them? If so, is that on a hard copy and signed by whom?
Apart form these are you been paid salary every month. What do you mean by "environment is not good"? These would help us in commenting/suggesting points better.

Hi,
This is the strategy of most of companies which they take all original certificate from employee and also sign a bond of surety but i am not understand why are candidate will sign and given PDC. If you have PDC of one lac than you could be start your own business instad block your career with this type of company.
anyway,
Read your entire agreement, is thare any terms related to seperation with company, according that you could submit resign and demand your certificates.
if company denied to give you may file a complaint at labor court.

Dear Sir, I total agreed with your comment. If environment is not good than how servive for 6 month in a company.

No we are campus placed by our college. And as per my knowledge the organisation wont have spent any rupees for our training. Only we are assigned our work and rest we googled out and did on our own. The company only focuses only on one line "whatever you dont know google it out" and thats what we do all the time.

The reason behind signing the bond was we dont wanted to lost an opportunity. Yes the cheque is dated one probably dated for april 2014. and we did not get any receipt for the submission of certificates. regarding work environment i will say that no superior is listening to our work. whatever may be the effort given by us it is never appraised rather it is critisized that as a fresher its not working. and as usual leg pulling and internal leg pulling have made the working environment even worse.

Regarding your PDC, you can write a registered post letter and ask the company not to present it to the bank. This is because, such agreements are void ab initio, that is it not applicable from the beginning. But getting your certificates back depends on mercy of the company. Try to discuss with your manager about letting you go without hassles. Alternatively, suffer the six months - it's not that long a period.
Sorry- no solutions in such cases.
