if your friend died while working then his dependents would be eligible to esi benefits. otherwise his dependents are not eligible to any compensation under ESI except for funeral benefit of Rs.3500/-.

Dear Friend, During course of employment,if IP Deceased his or her dependents can get funeral expense 5000 rupees.by filling form 25A or 26.to be filled by employer. with regards naresh.gadde

Don't get confused with many replies.....as an ESI Manager I will clarify ur doubt:
i) If he died out of non employment injury his living elder family member will get Rs.5,000=00 towards Funeral expenses for which they have to fill up the form, which should be countersigned by the employer;
ii) If he died due to employment injury(i.e. during his duty timings), his dependant family members will get pension........

As ESI Manager said please don't get confussed with too many reply's. Month back ESI Act is ammanded in it they have included
1. Accidents arising out of & in course of employment is covered under ESI for all the benefits. (arising out of= journey residence to office and vice versa).
2. Kindly file an FIR, if it is an accident arrised journey from office to home or vice versa.
3. Get the death certificate.
4. Legal hearing from Local Thasildar.
and meet deceased employee, employer with all the above documents.

If your friend's death is due to non-employment injury the dependants will not get any thing except funeral expenses to the extent of Rs. 5000/- or the actual expenses which ever is lower. In case if the death is due to employment injury occurred during the course of employment or out of employment which includes the reasonable journey time from office to house and vice versa, then the dependants will get periodical dependants benefit as per the rates prescribed under Schedule 2 of the Act. Please keep it in mind also , if the death is due to heart attack while on duty or while coming to office or going to home due to stress and strain will also entitle the dependants to claim dependant benefit apart from funeral benefit.

As i already told that depend on the fact whether he died due to employment injury or not.
Further as of now the maximum Funeral benefit entitled to any Insured Person/woman is only Rs.5,000=00..
