I am working in a logistics company as a Manager-HR & Admin further the company is started in the year 2007 having branches PAN India in this regard we approached ESI office in the year 2008 and 2009 for ESI applicability and submitted required documents but the concern person came for inspection in year 2011 in the month of August and he did the inspection, given the report that we need to Pay the ESI payment of the employees and Company from April 2011 to August 2011 for all the Employees along with company Enrolment number in the month of August 2011.
We have not paid the same amount to them after that we are regularly paying amount to them but in the last month again they forward a letter to us to come their office and explain the reason for not paying amount from April 2011 to August 2011 we clearly informed them that we have approached ESI office number of times but no action taken from their side - they said they have not agreed and issued a order to pay the amount but we are having every proof that we approached in year 2008 and 2009 submission slips with acknowledgement slips more over most of the employees left the org.
Now my query is where I need to approach and get it resolve.

1. Sir, in my opinion, it is more better to make the payment of contribution immediately to ESIC for which no compliance made. This will definitely, be followed by the said department by issue of demand letters/notice for payment of interests and damages for such delayed payments.
2. Your points that you wrote number of letters or visited ESIC offices etc. are no justification/excuse for your not paying contributions under said Act. I think, maximum you can demand for suitable action (if your plea is found correct) against the official of said office who did not replied to your repeated letters/query, but still the contribution alongwith interest and damages is required to be paid.

I'm completely agree with Mr. Harsh Mehta's comments and in addition to that, can you please check the ESIC as ESIC must have enrolled your organisation with effect from April,2011 and thus they are asking for the payment for April-August,2011. Contribution period for ESIC is April to September thus they had asked you to pay from April,2011.
