oe of my employee, who has joined us on 15 Sep, 2012, has her PF account in her previous company, Adobe. Now she wants to withdraw her PF from Adobe because it is not possible to transfer the amount. So regarding this she needs a declaration letter from our side stating that we do not have any provision for PF Account.
Could you plz provide the format for the same.

as per act & PF rules for any PF account withdrawals PF member should declare that\"I declare that I have resigned and not employed in any factory/ establishment to which the EPF scheme applies for the continuous period of not less than 2 months immediately preceding the data of my application for final withdrawal of my provident fund money.(PF Form-19)\". as per above rule no PF member cant work in any PF covered Factory/Establishment with in 2 months form the resignation of PF account. But actually this rule was not be implemented in any establishment and also PF authorities are also not particular about this rule. so as per your question there is no need to give separate declaration its already in the withdrawal F-19. and my question is that why do you think transfer is not possible. generally transfer is possible. Transfer is the actual rule of EPF when any person changed the employment.

Actually transfer is not possible because my company is on very small level. We do not have PF account system. Because of this my employee need a declaration from our side that we do not have any PF Account system in our company.

Ok. However, I think she only needs the form signed by her earlier employee. There is no provision for new employer signing in case of a withdrawal

Dear Ms. Shikha, You simply has to fill & file form No:19 & Form-10C by obtaining the signature of your previous employers. Also enclose form No.5 & Form No.10 of your previous employer. Ravi

Mr Ramanarayan is right .The employee need not enter in Form 19 that she is working with you.She must sumit the form after 2months declaring that she is not employed in any establishment under PF scheme.

No need to declare anything except the declaration mentioned in F No. 19 for withdrawal of P F money.
So, simply fill up the form no. 19 and get it attested from the employer of the firm in which you have been member of P F.
