R/Sir,
I am working in Automobile manufacturing company in punjab. In our company the staff working timing is 10 hrs.(i.e 9.00 to 7.00). Is it legal to work 10 hrs. in a day. If not what we should do.

Dear Naresh,
Subject to the provisions of Section 51, no adult worker shall be required or allowed to work in a factory for more than nine hours in any day,
But, Appropriate government may make rules in respect of adult workers in factories providing for the exemption, to such extend and subject to conditions as my be prescribed .of workers engaged on urgent repairs, from the provisions of Section 51,52,54,55 & 56.
if workers engaged in any work which for technical reasons must be carried on continuously from the provisions of Sections 51,52,54,55 and 56 of the Factories Act, 1948.

Dear Naresh ji,
Your query is incomplete. You have not mentioned about the rest intervals. You have only mentioned the total spread over.
Your attention is drawn to section 56 of FA which stipulates that the period of work of an adult worker in a factory shall be so arranged that, inclusive of his intervals for rest under section 55, it shall not spread over more than ten and half hours on any day.

Shri Naresh, Are you working in factory or in the office which is seperate from the factory. The Factories Act would apply in case you are in factory and as pointed out by Shri Korgaonkar and Shiv Kumar, this appears excessive. But in case it is an office establishment, provision of Punjab Shop & Establishment Act have to be examined. Pl furnish more details for clearly stating the legal provision.

I have another query related to Gratuity. If a person working in manuf. indus. in Punjab for continuous 5 yrs 3 months, then how many yrs.+ months gratuity he is eligible and also if he works for 5 yrs 9 months then how many yrs + months gratuity he is eligible for. Plz. guide me by your valuable knowledge.
