when the worker going to his home after doing his duty in shift he fell down on the path. Recently he was hospitalize and the dr. declared brain hamerague and now he is under treatment.in my view the brain humerague is not an accident, this is the natural disease because he was suffering from blood pressure for a long time. My question that if brain hamerague during the course of employment is liable to employer for compensation.

Dear Rajender
Please confirm about the Mediclaim policy personally he holds. What is the stand on Hospitalisation expenditure (on natural illness and on Injury out of and during the course of work) of the employee of your organisation. How you have concluded that the brain hamerrage is due to some injury or due to Hyper Tension.
What is the remarks given by the Authorised Hospital authorities of your organisation.
In case if the brain hamerrage is caused due to any head injury then obviously it must be considered as Industrial Accident and the organisation has to bear the expenditure and compensation (if not supported by the Group Personal Accident Policy by WC Act or ESI Act.
If the same is happened due to work pressure, then he might have collapsed within 24 hours. But a small head injury can also become severe in case a victim a Hyper Tension Patient.

Dear Mr. Rajendra,
Since the employee was not on duty while accident happened, company is not liable to pay for compensation. But the latter may consider it if it thinks it would help in other employee retention.
