Dear Sir,
I am working in a contract based construction company under principal employer i.e. HPCL at HPCL Depot. Haryana.
Our labour strength is more than 20 & we applied for Labour Licence & Registration Certificate. We got the Labour Licence for the same but Labour Commissioner denied to issue Certificate of Registration for this job. He replied that this HPCL depot falls under factory act & we can not issue any Certificate of Registration. But my principal employer asking for Registration Certificate under BOCW. Also he is asking for ESI Registration rather we have a WC policy of all the workers.
Now my question is:-
1. Is the principal employer is right? should we apply for Certificate of Registration under BOCW if yes, then where to apply because central govt. has denied for the same.
2. ESI is applicable on us rather we have a WC policy for all the workers?
