Sir,
We are engaged in the construction of buildings and we have 10 employees drawing salary less then 15000/- and we have two contractors deployed at our construction sites.
Kindly clarify whether ESI Act is applicable in the construction sites and are we bound to register ourselves under ESI Act.

Employees who are employed in construction sites are not covered by ESI. Therefore, your establishment will not be covered by ESI. Regards, Madhu.T.K

As far as registration of employees in the construction field, the workers related to construction especially like masons, labourers are not covered under ESI.....
But the construction office, which is having 20 clerical staff, supervisors, etc.. are coverable under the provisions of the act.................

Dear all,
Please provide me notification regarding expemption of ESI Act in construction projects.
Please clarify whethet our contractors having more then 25 labours have to registration under ESI or are they also exempted.
But the construction office, which is having 20 clerical staff, supervisors, etc.. are coverable under the provisions of the act. In this wages are taken into consideration or strength of employees.

When ever ESI go for coverage of an unit/estt/factory it will look into the coverable employees, i.e. both wages and strength will involve, more clearly if an unit is having 10 or more coveable employees(drawing less than or equal to 15000), then that unit is coverable under the provisions of the Act...........

Now construction workers who are engaged at sites are also covered by ESI Schemes.
Similarly for coverage to establishments, total number of employees will be taken into account. The earlier provision of considering only those whose salary comes under coverable limit stands withdrawn and therefore, if you employ 10/20 employees your establishment shall become covered even if none of the employees is getting less than Rs15000.
